Después de siete años de investigación penal, el Primer Juzgado Mixto de Huancabamba resuelve absolviendo de responsabilidad penal a 107 personas (entre campesinos, alcaldes provinciales y otros) acusados falsamente de la comisión de diversos delitos supuestamente cometidos durante la marcha de sacrificio pacífico de campesinos al campamento minero de Majaz S.A.
En agosto de 2005 campesinos marcharon pacíficamente al campamento minero Majaz (hoy Río Blanco). 28 personas fueron arbitrariamente detenidas y torturadas por efectivos policiales.
A fines de julio e inicios de agosto de 2005, los integrantes de las Comunidades Campesinas de Segunda y Cajas, Yanta, y otras comunidades de la región, afectadas por la presencia ilegal de la Empresa Minera Río Blanco Copper S.A. (antes Majaz S.A.), realizaron una marcha pacífica hacia el Campamento Henry´s Hill a fin de iniciar un dialogo con las autoridades y los representantes de las empresa, sin embargo, fueron brutalmente reprimidos, 28 de ellos detenidos arbitrariamente en las instalaciones del campamento minero, y sometidos a actos de torturas físicas y psicológicas.
El Fiscal Provincial de Huancabamba, en esa fecha Lorenzo Félix Toledo Leyva, quien se apersonó al campamento de la empresa y observó a los comuneros ensangrentados y golpeados, en lugar de tomar medidas de protección para las personas torturadas, por el contrario, sin fundamento alguno decidió denunciar a 107 personas, entre ellas alcaldes distritales y provinciales, así como a las 28 personas que fueron víctimas de las torturas arriba citadas.
En enero de 2009, se archivó la denuncia contra los alcaldes procesados por supuesto delito de malversación de fondos, subsistiendo la denuncia sobre otros delitos, por ello, durante casi siete años han tenido que defenderse de las graves imputaciones formulados en su contra como son la supuesta comisión de los delitos de sustracción y arrebato de armas de fuego, complicidad en el delito contra la vida, el cuerpo y la salud en la figura de lesiones, delito por entorpecimiento al funcionamiento de los servicios públicos, etc., imputaciones que carecían de todo fundamento, como ha que ha quedado plenamente acreditado a través de este proceso penal y que ha llevado a que el Primer Juzgado Mixto de Huancabamba (Expediente No. 140-2005, Especialista Legal Secretario Alfredo Vinces Salazar) emita la correspondiente sentencia absolviendo de responsabilidad penal a las 107 personas procesadas.
FEDEPAZ considera que la sentencia aquí citada es una prueba de que el proceso penal abierto contra todas estas personas sólo tuvo como objetivo ocultar la brutal represión policial contra centenares de comuneros y los gravísimos actos de tortura antes citados (cuyo caso viene siendo investigado por el Primer Juzgado de la Investigación Preparatoria de Huancabamba, Expediente No. 30-2010).
Asimismo, estima que la actitud del ex fiscal Lorenzo Félix Toledo Leiva (hoy preso por delito de corrupción de funcionarios y actualmente procesado por haber omitido denunciar los actos de tortura antes referidos) se enmarcó dentro del contexto de reprimir la protesta social criminalizando injustamente a los comuneros, sin ninguna prueba y por actos que, en realidad, significan ejercicios legítimos de sus derechos a exigir diálogo para la solución de su problemas comunales, de efectuar protestas públicas pacíficas (mediante marchas de sacrificio), etc.
Finalmente, FEDEPAZ está convencida de que la existencia de procesos penales contra personas inocentes que duran tanto años, como en el presente caso, es posible por la existencia de normas que criminalizan el legítimo derecho de las comunidades rurales o urbanas de expresarse públicamente y de protestar cuando sus justas demandas no son atendidas por el Estado. En ese sentido, reitera su exigencia a las autoridades del poder legislativo a derogar, en forma inmediata, los decretos legislativos que criminalizan la protesta social, por violar derechos fundamentales, la Constitución Política del Perú y Tratados Internacionales de Derechos Humanos que el Perú ha suscrito.
