Cuarta Fiscalía Superior Penal de Piura señala que se ha probado que el ex Fiscal Provincial de Huancabamba actuó de manera consciente y voluntaria al omitir denunciar las torturas. Solicita se le condene a 4 años de pena privativa de la libertad.
La Cuarta Fiscalía Superior Penal de Piura ha formulado acusación fiscal por delito de omisión de denuncia contra Lorenzo Félix Toledo Leiva, solicitando se le sentencia a cuatro años de pena privativa de la libertad y al pago de S/. 10,000 por concepto de reparación civil a favor del Estado, porque en su condición de Fiscal de la Primera Fiscalía Provincial Mixta de Huancabamba conoció de las torturas a las que fueron sometidos 28 campesinos en el campamento minero de la empresa Río Blanco Copper S.A. (antes llamada Majaz S.A.), pero incumpliendo sus funciones, con plena conciencia y voluntad, omitió denunciar penalmente los hechos.
Como ya es de conocimiento público, entre los día 1 y 3 de agosto de 2005, 28 campesinos fueron torturados por quienes los mantenía cautivos, entre los que se encontraban efectivos de la policía nacional, funcionarios y trabajadores de Río Blanco Copper S.A. y de la empresa de seguridad privada Forza, por lo cual, a la fecha existen dos investigaciones penales, una en la que ya se ha formulado requerimiento de acusación contra dos coroneles y doce miembros (entre oficiales y sub-oficiales) de la Policía Nacional del Perú, contra quienes se solicita se imponga 10 años de pena privativa de libertad y, otra en etapa de investigación preliminar seguida contra dos generales y más de trescientos sub-oficiales de la misma policía, así como contra funcionarios y trabajadores de Río Blanco Copper S.A. y Forza. Cabe resaltar que en esta última investigación también se encuentra imputados dos médicos por haber expedido certificados médicos falsos.
En este proceso penal seguido en contra del referido ex fiscal (el mismo que se encuentra cumpliendo condena en el Penal de Río Seco en Piura, por delito de corrupción de funcionarios) las víctimas vienen siendo patrocinadas por los abogados de la Fundación Ecuménica para el Desarrollo y la Paz (FEDEPAZ), quienes consideran que la Acusación y el pedido de imposición de 4 años de pena privativa de la libertad formulada por la Cuarta Fiscalía Superior Penal de Piura constituye un avance fundamental en la lucha contra la impunidad en las violaciones de derechos humanos y contra los crímenes de lesa humanidad, reafirmándose en la necesidad de que se haga justicia a las víctimas en este caso y se las repare de forma integral, así como se denuncie, investigue y sancione a todos los que han tenido responsabilidad en esta brutal agresión a humildes campesinos que no hicieron otra cosa que solicitar diálogo para defender su derecho a la tierra, vivir en un medio ambiente sano y sostenible y poder elegir, legítimamente, su propio modelo de desarrollo local.
Tal como lo hizo en la oportunidad en que las víctimas fueron indemnizadas por Monterrico Metals Plc. (casa Matriz de Río Blanco S.A.) y en el momento en que se formuló acusación fiscal contra 14 efectivos policiales (entre ellos dos coroneles), igualmente, ahora, FEDEPAZ expresa su satisfacción por el hecho de que las víctimas y sus familiares sigan firmes en el camino de obtener la sanción penal justa contra todos aquellos (policías, funcionarios y trabajadores de la empresa minera y de seguridad, etc.), que de una u otra forma, son responsables en los graves crímenes que cometieron en su contra (la tortura, reiteramos, es un delito de lesa humanidad).
Finalmente, FEDEPAZ se reitera en la necesidad de mejorar los marcos normativos del sector minería que permitan establecer condiciones adecuadas para que las empresas se vean realmente obligadas a respetar los derechos de las personas y especialmente de los pueblos indígenas. Igualmente, se reitera en la necesidad de revisar y derogar todo el conjunto de normas que criminalizan la libre expresión y la legítima protesta social (compromiso de revisión asumido por el Estado Peruano ante la Comisión Interamericana de Derechos Humanos, el 25 de octubre de 2011, durante la Audiencia sobre la política de derechos humanos del nuevo gobierno). Por ello, reitera su exigencia para que el Poder Legislativo apruebe, sin más dilación, las normas que garanticen el respeto y promoción de los derechos humanos en nuestro país.
