26 de junio: Día Internacional de las Naciones Unidas en Apoyo de las Víctimas de Tortura
¡Detengamos la tortura! Por la aprobación inmediata del Mecanismo Nacional de Prevención de la tortura
La tortura constituye una grave violación de los derechos humanos, condenada tanto por el derecho internacional (1) como por el derecho interno. Sin embargo, la tortura sigue siendo un problema vigente en nuestro país: tan sólo en el 2011 la Defensoría del Pueblo recibió 62 denuncias por presuntas torturas y tratos crueles, inhumanos o degradantes, mientras que en el período 1998-2010, ha reportado 640 denuncias por tortura. Estas cifras, se teme, representan un sub-registro, dado que muchas personas que sufren esta práctica no llevan a cabo su denuncia, ya sea porque se sienten desprotegidas ante el Estado, o porque no saben que el maltrato que han recibido constituye efectivamente el delito de tortura. Cabe resaltar que es preocupación de los sectores sociales que luchan contra la tortura que el Código Penal no haya previsto, expresamente, la imprescriptibilidad del delito de tortura, sino que, por el contrario, lo haya sujetado a los plazos ordinarios del mismo Código.
La diversidad de las regiones en donde se han producido estos hechos de tortura así como sus circunstancias mismas, muestran que el problema tiene una dimensión nacional y no está únicamente ligado al combate al narcotráfico o terrorismo, o a zonas bajo estado de emergencia, sino que también aparece en el contexto de la lucha contra la criminalidad común.
En este contexto, y con miras al Día Internacional de las Naciones Unidas en Apoyo de las Víctimas de Tortura (26 de junio), tenemos que preguntarnos, como sociedad, ¿qué podemos hacer para prevenir la práctica de la tortura en nuestro país?
El Protocolo Facultativo de la Convención contra la Tortura es un tratado internacional que establece un sistema de visitas periódicas a cargo de órganos internacionales y nacionales independientes a los lugares en que se encuentren personas privadas de su libertad, con el fin de prevenir la tortura y otros tratos o penas crueles, inhumanas o degradantes. Este Protocolo establece un sistema dual de prevención de la tortura que consiste en un mecanismo internacional cuya labor se complementa con la de un mecanismo nacional. El mecanismo internacional, entidad de las Naciones Unidas, es el Subcomité para la Prevención de la Tortura, mientras que el Mecanismo Nacional de Prevención (MNP) debe ser una entidad designada por los Estados parte. Ambos mecanismos cuentan con la facultad para efectuar visitas a los lugares de detención.
No obstante, si bien el Protocolo Facultativo fue ratificado por el Perú el 14 de septiembre del 2006 y entró en vigor el 14 de octubre del mismo año, no se cumplió con el plazo de un año, esto es al 14 de octubre de 2007, para que se cree el MNP. En efecto, se van a cumplir cinco años y, a la fecha, el Estado Peruano no ha cumplido con el establecimiento del MNP. Al respecto, si bien se ha aprobado al interior del Consejo de Derechos Humanos (CNDH) un proyecto de norma legal para su creación, la misma se encuentra estancada en proceso de debate y consulta en el Ejecutivo previo a su envío al Congreso de la República.
Desde la sociedad civil, consideramos que esta situación es inaceptable, que no existe ningún motivo para seguir prolongando la aprobación de un mecanismo cuyo único fin es la protección de los ciudadanos. Exigimos, por tanto, el establecimiento inmediato del Mecanismo Nacional de Prevención de la Tortura.
Más sobre el Mecanismo Nacional de Prevención (MNP)
El proyecto de ley sobre el MNP ha sido elaborado con los aportes de la sociedad civil que conforman el Grupo de Trabajo contra la Tortura (GTCT) de la Coordinadora Nacional de Derechos Humanos (CNDDHH), y establece como competencia lo siguiente:
- Examinar periódicamente el trato y las condiciones de detención de las personas privadas de libertad, a través de las visitas periódicas a cualquier centro de detención (2), con o sin previo aviso, eligiendo con libertad los lugares que visitará.
- Formular recomendaciones a las autoridades competentes con el objeto de mejorar el trato y las condiciones de las personas privadas de libertad, tomando en consideración las normas pertinentes del derecho internacional de los derechos humanos.
- Formular propuestas y observaciones acerca de la legislación vigente o de los proyectos de ley, así como de las normas de carácter administrativo en materia de prevención de tortura.
Esto incluye la potestad para acceder a toda la información relacionada al régimen de detención, número de personas privadas de libertad, identificación de los centros de detención y su ubicación, así como la potestad de entrevistar a cualquier persona privada de su libertad, sin testigos, personalmente, en un lugar que garantice la confidencialidad de la entrevista. Del mismo modo, incluye la potestad de solicitar a cualquier entidad, pública o privada, el apoyo necesario para el cumplimiento de sus funciones.

- Así, en el ámbito internacional, la Declaración Universal de Derechos Humanos, proclama en su artículo 5 que: “Nadie será sometido a torturas ni a penas o tratos crueles, inhumanos o degradantes”. Según la Convención Interamericana para Prevenir y Sancionar la Tortura de la OEA, la tortura refiere a “todo acto realizado intencionalmente por el cual se inflijan a una persona penas o sufrimientos físicos o mentales, con fines de investigación criminal, como medio intimidatorio, como castigo personal, como medida preventiva, como pena o como cualquier otro fin”, entendiéndose al mismo tiempo “como tortura la aplicación de métodos tendientes a anular la personalidad de la víctima o a disimular su capacidad física o mental, aunque no causen dolor físico o angustia psíquica”[artículo 2] [↩]
- Cuando en el proyecto de ley se habla de centros de detención que están dentro del campo de acción del MNP se considera a “los lugares, espacios o entidades donde se encuentren o se presume que se encuentre personas privadas de su libertad, sean estos públicos o privados, independientemente de que los mismos hayan sido o no reconocidos conforme a la presente ley como lugares de privación de la libertad”. Esta definición incluye no sólo dependencias o establecimientos del Instituto Nacional penitenciario, de la Policía Nacional y de las Fuerzas Armadas, sino también centros juveniles, establecimientos de salud, instituciones psiquiátricas, centros de salud mental, aldeas infantiles, centros geriátricos, etc. [↩]
