Los Estados tienen un deber: garantizar y proteger los derechos humanos de todas las personas bajo su jurisdicción. Cuando alguno incumple esta obligación, existe la posibilidad de acudir ante instancias internacionales para buscar la justicia que este no brindó.
Una de estas alternativas es el Sistema Interamericano de Protección de los Derechos Humanos (SIDH) al cual peruanas y peruanos podemos acudir dado que nuestro Estado ratificó la Convención Americana sobre Derechos Humanos (CADH) el 12 de julio de 1978 y reconoció la competencia contenciosa de la Corte Interamericana de Derechos Humanos, sometiéndose así a su jurisdicción.
En la actualidad, la violencia y la discriminación hacia lesbianas, gays, bisexuales y trans1 (LGBT2) basadas en el repudio a nuestra orientación sexual y/o identidad de género y el hecho que el Estado las tolere y las refuerce hacen propicia la presentación de denuncias ante este sistema.
Ciertamente, pocos sabíamos que existía, pocos sabemos qué es, pocos saben que no es tan difícil acceder a él. Sin embargo, este sistema es un espacio internacional que no deberíamos desaprovechar pues ofrece una serie de mecanismos políticos y legales para visibilizar graves vulneraciones a los derechos humanos.
El SIDH está compuesto por dos instancias independientes y a la vez complementarias: la Comisión Interamericana de Derechos Humanos (CIDH) y la Corte Interamericana de Derechos Humanos. Su principal función es velar por el respeto, la protección y la realización de los derechos humanos en el continente americano. Para ello realiza acciones de monitoreo con el fin de conocer si los Estados cumplen con las obligaciones contraídas en la CADH.
